Booking Terms and Conditions

GENERAL BOOKING CONDITIONS

These General Booking Conditions (hereinafter referred to as the “General Conditions”) govern the commercial relationship that arises between MAC HOTELS and its associated companies (as listed at the end of this document) and the user or client through bookings made using the forms provided by MAC HOTELS on its websites: www.mac-hotels.com, www.macpuertomarina.com, www.paradisogarden.com, and www.clubmac.es.

Booking through MAC HOTELS’ websites implies the explicit acceptance by the client or user of these sites of these conditions, as well as the terms of use established for browsing the pages owned by MAC HOTELS.

These conditions shall apply without prejudice to the applicable legal provisions for each specific case.

These General Conditions of Contract govern the distance selling relationship between MAC HOTELS and the user or client, in accordance with the legal provisions, in particular: Law 7/1998 of 13 April on General Contracting Conditions, Law 3/2014 of 27 March amending the revised text of the General Law for the Defence of Consumers and Users, Organic Law 15/1999 of 13 December on the Protection of Personal Data, General Data Protection Regulation, Law 7/1996 of 15 January on Retail Trade Regulation, and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.

MAC HOTELS reserves the right to make any modifications it deems appropriate, without prior notice, to these General Conditions. Such modifications may be made through its websites by any means legally permissible and shall be binding for as long as they are published on the website and until they are validly replaced by subsequent ones. However, MAC HOTELS reserves the right to apply Specific Booking Conditions with preference over these General Conditions where deemed appropriate, and will announce them in due form and time.

Pre-booking Information

MAC HOTELS informs that the booking procedure through its websites is detailed in the relevant section for formalizing the booking.

MAC HOTELS also informs that users can access the terms of use provided on the same website.

By booking with MAC HOTELS through its website, the user or client expressly declares to be aware of, understand, and accept said terms of use and the General Conditions. Similarly, the user declares to be of legal age and to have the legal capacity to enter the MAC HOTELS websites and to make bookings through them. The user agrees to keep their login and password confidential and not to share them.

Once the booking is completed, the user will see the booking confirmation on screen, which can be printed as proof of booking. The booking confirmation and proof (printout by the user) are not valid as invoices.

BOOKING PROCEDURE

Booking Offer and Price Reference

In compliance with current regulations, especially Law 34/2002 on Information Society Services and Electronic Commerce, MAC HOTELS provides detailed information on all possible bookings, their characteristics, and prices in the relevant booking section. However, MAC HOTELS reserves the right to withdraw, replace or change the offers made to clients through its website simply by changing the content. Accordingly, the products and/or services offered at any given time will be governed by the General Conditions in effect at that time. The company may also stop offering access to these products and/or services at any time without notice.

Price Indication

Each potential booking will indicate its price and whether VAT or any other applicable tax is included. The prices shown on screen are current unless there is a typographical error. If the price differs due to such an error, MAC HOTELS will notify the client by email before proceeding to charge the booking.

Availability

The availability of offers provided by MAC HOTELS may vary depending on customer demand. Although MAC HOTELS updates its database periodically, the requested booking may be full at that time. In this case, MAC HOTELS will notify the customer by email that the offer is no longer available.

Payment Methods

For bookings made through its website, MAC HOTELS requests credit card details from the booking holder to guarantee the reservation. Cards are stored in compliance with PCI DSS standards.

MAC HOTELS informs that the payment method for each offer will be indicated at the time of viewing the offers.

1. Bookings Paid Upon Arrival:

Please note that no charges are made to your credit card when making this reservation. The card is used only as a guarantee.

However, the establishment reserves the right to pre-authorize your credit card before arrival. The invoice will be settled directly at the establishment, in cash, by credit card, or any other accepted method.

Upon request, payment can be made before check-in via bank transfer or by secure payment link sent by email.

a. Bank Transfer

If you select bank transfer, you will receive confirmation by email with the hotel’s bank details.

It is very important to include the reference number, your full name, and make the transfer within 3 days of the confirmation date for validation.

You may send proof of payment to the hotel’s reservations email, but in any case, the service is not considered validated until our administration department receives bank confirmation.

Payment must be made in Euros, and any currency exchange or bank fees are at your expense.

For transfers made from outside Spain, always instruct your bank to cover any origin fees or bank charges. If not, the hotel may halt the service due to not receiving the full amount.

Any bank or currency exchange fees are the client’s responsibility.

2. Non-Refundable Bookings:

For non-refundable bookings, 100% of the booking amount will be charged via the payment gateway. No refunds will be granted for cancellations, early departures, or no-shows (the booking will only be held for the first night). If payment is denied, the hotel will cancel the booking.

3. Bookings with Deposit:

If a deposit is required to guarantee the reservation, it will be charged during the booking process via bank card.

Travel Agency Bookings

MAC HOTELS has a dedicated B2B website for agency sales. Please consult booking conditions at www.machotelspro.com. Guests using additional services during their stay may pay upon consumption or provide a card number to accumulate credit.

Booking Cancellation

Please refer to your specific booking conditions to check the cancellation window for free cancellation / deposit refund.

Cancellation of non-refundable bookings will not result in any refund.

Your booking conditions will also specify no-show charges without prior cancellation.

Withdrawal

In accordance with Article 103 of Law 3/2014 of 27 March (which modifies the revised text of the General Law for the Defense of Consumers and Users), the supply of services or goods customized or made to consumer specifications, or those that by nature cannot be returned or may deteriorate quickly, are exempt from withdrawal.

DATA PROTECTION

In accordance with current Personal Data Protection regulations, we inform you that your data will be incorporated into a data processing system owned by MAC HOTELS (CIF A07305477), with registered office at GREMI TINTORERS 25A, 07009 PALMA, ILLES BALEARS, SPAIN, for the purpose of facilitating, expediting, and fulfilling the commitments between the parties. Your data will be kept for the time strictly necessary to comply with the purposes described.

Unless you notify us otherwise, we will assume that your data has not changed, and that you agree to notify us of any changes and allow us to use it for the mentioned purposes.

MAC HOTELS will treat the data lawfully, fairly, transparently, appropriately, relevantly, accurately, and up to date, committing to delete or rectify it promptly if it becomes inaccurate.

According to your rights under current data protection laws, you may exercise your rights of access, rectification, restriction, erasure, portability, and objection, as well as withdraw your consent, by writing to the postal address above or to dpo@mac-hotels.com.

You may also contact the competent Supervisory Authority to file any complaint.

APPLICABLE LAW AND JURISDICTION

MAC HOTELS also reserves the right to take civil or criminal action as it deems appropriate for improper use of its website or breach of these terms.

The relationship between the user and the provider shall be governed by the applicable laws of Spain. In case of dispute, parties may choose arbitration or submit to ordinary jurisdiction following rules of jurisdiction and competence. MAC HOTELS is based in ILLES BALEARS, Spain.

RIGHT OF ADMISSION

We reserve the right of admission. Acting reasonably, MAC HOTELS may deny entry or request the departure of anyone (client or guest) whose presence or behavior could negatively affect the enjoyment, safety, or well-being of others. This includes but is not limited to: inappropriate or undesirable behavior, disorderly conduct, violent, aggressive, threatening, offensive, or discriminatory language or actions. Action may also be taken if a guest has previously filed legal claims against any of our properties, accessed restricted areas without authorization, or failed to follow internal property rules.

These actions may result in immediate and permanent expulsion from the premises, with cancellation of all contracted services without right to refund or compensation, including unused days. No alternative lodging or transport costs will be assumed.

We also reserve the right to take legal action against anyone who causes damage to facilities or furnishings or displays signs or visible messages deemed offensive or threatening. Action may also be taken against guests who receive legitimate complaints from other guests or attempt to access the facilities without an identifying wristband or proper authorization in all-inclusive properties. If the offender is part of a group, these measures may apply to the entire group.

BEHAVIOR AND CONDUCT POLICY

All guests must behave respectfully toward staff, facilities, and other guests. Please take care of common areas and rooms so that everyone can enjoy the space in optimal conditions. Excessive noise, especially at night, or behavior that may disturb others is strictly prohibited.

Offensive, illegal, or non-compliant behavior will not be tolerated. Any guest engaging in such conduct may be expelled without refund or compensation. Smoking (including e-cigarettes) is prohibited in all indoor areas and designated outdoor smoke-free zones.

Guests acting irresponsibly under the influence of alcohol, especially in relation to the care of minors, may be expelled immediately. The consumption, possession, or signs of use of illegal substances will result in expulsion and a ban, also without compensation.

Our facilities have security cameras to ensure proper operation of the complex. However, we are not responsible for the extent or content of the recordings.

LIABILITY FOR DAMAGES

We reserve the right to claim from the client any costs for damages to the facilities or other guests resulting from improper behavior, including legal costs and compensation. We may also include the responsible client as a party in any legal action initiated by third parties if negligence or misconduct is proven by the client or persons associated with the reservation.
