GENERAL BOOKING CONDITIONS
The present General Booking Conditions (hereinafter referred to as the “General Conditions”) govern the commercial relationship between MEDITERRANEAN LUXURY HOTELS SA and the user or client who enters into a contract using the forms made available by MEDITERRANEAN LUXURY HOTELS SA on its website www.mac-hotels.com.
Booking through the MEDITERRANEAN LUXURY HOTELS SA web pages implies the express acceptance by the client or user of these pages of these conditions, as well as the conditions of use established for the navigation of the user through the pages owned by MEDITERRANEAN LUXURY HOTELS SA.
These conditions are applicable without prejudice to the application of the relevant legal provisions that may be applicable in each case.
The General Conditions govern the distance selling relationship between MEDITERRANEAN LUXURY HOTELS SA and the user or client, in accordance with the legal provisions, in particular Law 7/1998, of 13 April, on General Conditions of Contract, Law 3/2014, of 27 March, which modifies the revised text of the General Law for the Defence of Consumers and Users, Organic Law 15/1999, of 13 December, on the Protection of Personal Data, General Data Protection Regulations, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.
MEDITERRANEAN LUXURY HOTELS SA reserves the right to make any changes it deems appropriate to the General Conditions without prior notice. Such modifications may be made on its websites by any legally authorised means and shall be binding during the time they are published on the website and until they are validly modified by subsequent modifications. However, MEDITERRANEAN LUXURY HOTELS SA reserves the right to apply specific contractual conditions in certain cases, in preference to these General Conditions, if it deems this appropriate, and will publish them in a timely manner.
Pre-booking information
MEDITERRANEAN LUXURY HOTELS SA informs users that the procedure for making a reservation through its web pages is described in detail in the corresponding section for formalising the reservation.
Likewise, MEDITERRANEAN LUXURY HOTELS SA informs users that they may consult the terms and conditions of use available on the same website.
By making a booking through the MEDITERRANEAN LUXURY HOTELS SA website, the user or client expressly declares that they are aware of, understand and accept these Terms of Use and the General Conditions. Likewise, the user declares to be of legal age and to have the necessary legal capacity to access the MEDITERRANEAN LUXURY HOTELS SA websites and to enter into contracts through them. The user is responsible for ensuring the confidentiality of the username and password obtained when registering as a customer and should refrain from disclosing these to third parties. Once the booking has been made, the user will see the booking confirmation on the screen, which can be printed and used as a booking receipt.
The Booking Confirmation and the Booking Receipt (printed by the User) do not constitute an invoice.
BOOKING PROCEDURE
Booking offers and prices.
In accordance with current legislation and, in particular, with Law 34/2002 on Services of the Information Society and Electronic Commerce, MEDITERRANEAN LUXURY HOTELS SA provides information on all possible bookings, their characteristics and prices in the section dedicated to the formalisation of the booking. However, MEDITERRANEAN LUXURY HOTELS SA reserves the right to withdraw, replace or modify the offers made to its clients through its website, simply by modifying their content. Consequently, the products and/or services offered on the MEDITERRANEAN LUXURY HOTELS SA website at any given time shall be governed by the General Conditions in force at that time. Likewise, the company has the right to stop offering access to the aforementioned products and/or services at any time and without prior notice.
Display of prices.
The price shall be indicated for each reservation, together with VAT or other applicable taxes, as the case may be. The prices displayed on the screen are those in force at any given time, unless there is a typographical error. If the price differs for the above reason, MEDITERRANEAN LUXURY HOTELS SA will inform the client by email before proceeding with the booking.
Availability.
The availability of the products offered by MEDITERRANEAN LUXURY HOTELS SA through its website may vary according to customer demand. Although MEDITERRANEAN LUXURY HOTELS SA regularly updates its database, the reservation requested by the client may no longer be available at that time. In such a case, MEDITERRANEAN LUXURY HOTELS SA will send an email to the client informing them of the unavailability of the offer.
Methods of payment.
MEDITERRANEAN LUXURY HOTELS SA requests the credit card details of the holder of the reservation in order to guarantee the validity of the reservation. MEDITERRANEAN LUXURY HOTELS SA informs that the method of payment will be determined at the time of viewing the offers.
Reservations Payment on arrival: We remind you that the establishment does not charge your credit card when you make this reservation. The card will only be used as a guarantee.
The establishment reserves the right to verify the validity of the credit card before arrival. The invoice corresponding to the reservation shall be paid directly at the establishment, either in cash, by credit card or by any other means accepted by the establishment.
At the client’s request, payment may also be made before check-in by bank transfer or by card via BANCO DE SABADELL’s PHONE&SELL.
Bank transfer: If you choose to pay by bank transfer, you will receive a confirmation email with the hotel’s bank details.
It is very important that you quote the reference number in the subject line of the transfer, as well as your name and surname, and that you make the transfer within 3 days of the confirmation date in order to validate it.
If you wish, you can send us proof of the transfer by email to reservaspm@mac-hotels.com. In any case, the validation of the service will not be considered effective until our administration department has received the bank confirmation of the transfer.
We remind you that payment must be made in Euros and that any exchange or bank charges will be your responsibility.
In the case of bank transfers from outside Spain, it is very important that when ordering the transfer, you always inform your bank of the commissions at source, that is, the bank commissions and expenses corresponding to your bank. Otherwise, $Empresa may cancel the contracted service if we do not receive the full amount.
All exchange and bank fees and commissions are the responsibility of the customer”.
Non-refundable bookings: If a non-refundable booking is made, 100% of the booking amount will be charged via Redsys.
Travel Agency Bookings If a booking is made through a travel agent, full payment must be made at the time of booking and is non-refundable. Guests who opt for additional services or extras can pay at the time of consumption or, if they wish to accumulate credit, they must provide their credit card number.
Cancellation of reservations.
Payment on arrival: If the cancellation is made before 23:59 the day before the reservation, no charge will be made by the establishment. Cancellation after 23:59 or no-show will entitle the establishment to charge 50% of the total amount of the reservation to the credit or debit card number provided.
Non-refundable fare: Cancellation will always entail a penalty. When the hotel receives the booking, the full amount will be charged to your credit card. No refunds will be given for cancellations, early departures or no-shows (the reservation will be held for the first night only). If payment is refused, the hotel will cancel your reservation.
Cancellation.
In accordance with the provisions of Article 103 of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, the supply of services or goods made to the consumer’s specifications or clearly personalised, or which by their nature cannot be returned or may deteriorate or expire quickly, are excluded from the right of withdrawal.
DATA PROTECTION
In accordance with current legislation on the protection of personal data, we hereby inform you that your details will be included in an automated file belonging to MEDITERRANEAN LUXURY HOTELS SA, CIF A07305477, with registered offices at GREMI TINTORERS 25A 07009, PALMA DE MALLORCA (ILLES BALEARS), to facilitate, expedite and fulfil the obligations agreed between the parties. In accordance with current legislation, MEDITERRANEAN LUXURY HOTELS SA informs you that your data will be kept for the time strictly necessary to fulfil the aforementioned obligations.
Unless you inform us to the contrary, we will assume that your data have not been modified, that you undertake to notify us of any modification and that we have your consent to use them for the aforementioned purposes.
MEDITERRANEAN LUXURY HOTELS SA informs you that it will process your data in a lawful, loyal, transparent, adequate, relevant, limited, accurate and up-to-date manner. For this reason, MEDITERRANEAN LUXURY HOTELS SA undertakes to take all reasonable measures to ensure that the data is cancelled or rectified without delay if it is inaccurate.
In accordance with the rights conferred by current data protection legislation, you may exercise your rights of access, rectification, restriction, cancellation, portability and opposition to the processing of your personal data, as well as your consent to its processing, by sending your request to the postal address above or to the email address dpo@mac-hotels.com.
You may contact the competent supervisory authority to lodge any complaint you deem appropriate.
APPLICABLE LAW AND JURISDICTION
MEDITERRANEAN LUXURY HOTELS SA also reserves the right to take any civil or criminal action it deems appropriate in the event of improper use of the website and its contents or breach of these conditions.
The relationship between the user and the provider is governed by the regulations in force in Spain. In the event of any dispute, the parties may submit their disputes to arbitration or bring them before the ordinary courts, in accordance with the relevant rules of jurisdiction and competence. The registered office of MEDITERRANEAN LUXURY HOTELS SA is in ILLES BALEARS, Spain.
RIGHT OF ADMISSION
We reserve the right of admission. Acting reasonably at all times, the establishment may deny entry to or request the departure of any person (whether guest or visitor) whose presence or behavior may negatively affect the enjoyment, safety, or well-being of other guests or staff. This includes, but is not limited to: inappropriate or undesirable behavior, disturbances, use of violent, aggressive, threatening, offensive, or discriminatory language, as well as insults or disruptive actions. The establishment may also act in cases where legal proceedings have been initiated against any of our properties in the past, unauthorized access to restricted areas, or failure to comply with the internal rules of the accommodation.
These actions may result in immediate and permanent expulsion from the establishment, canceling all contracted services without any right to refund or compensation, including unused nights. The establishment will not assume responsibility for alternative accommodation costs or return transportation.
We also reserve the right to take legal action against anyone who causes damage to facilities or furniture or displays banners, signs, or any visible manifestation that could be considered offensive or threatening. Likewise, action may be taken against anyone who has caused justified complaints from other guests or who attempts to access the premises without the required identification bracelet or authorization in the case of all-inclusive establishments. If the offender is part of a group, we reserve the right to apply these measures to the entire group if deemed necessary.
BEHAVIOR AND CONDUCT POLICY
All guests are expected to behave respectfully towards staff, facilities, and other guests. We kindly ask you to take care of common areas and rooms so that everyone can enjoy the premises in optimal conditions. Excessive noise, especially at night, or attitudes that may cause discomfort to others are strictly prohibited.
Offensive, illegal, or otherwise unacceptable behavior in violation of the establishment’s rules will not be tolerated. Any guest engaging in such conduct may be expelled without the right to a refund or compensation. Smoking (including electronic cigarettes) is prohibited in all indoor areas and in any outdoor areas designated as smoke-free.
Individuals acting irresponsibly under the influence of alcohol — especially in relation to the care of minors in their charge — may be expelled immediately. The consumption, possession, or any indication of illegal substance use will result in expulsion and a permanent ban from the premises, also without compensation.
Our facilities are equipped with security cameras to ensure the proper functioning of the complex. However, we are not responsible for the scope or content of the recordings.
LIABILITY FOR DAMAGES
We reserve the right to claim from the guest the costs of any damage or harm caused to the facilities or other guests as a result of inappropriate behavior, including legal expenses and compensations. We may also name the responsible guest as a party to any legal action initiated by third parties if it is proven that there was negligence or misconduct on their part or by persons associated with their booking.
